CONSOLIDATED CITY OF INDIANAPOLIS COUNTY OF MARION STATE OF INDIANA
EXECUTIVE ORDER NO. 5, 2002
DISSOLUTION OF THE TOWN OF BRIGHTWOOD, INDIANA
WHEREAS, I.C. 36-5-1.1-1 provides the procedure for the dissolution of “included towns” (as defined by I.C. 36-3-1-7); and
WHEREAS, the Town of Brightwood (“Town”) is an included town; and
WHEREAS, pursuant to I.C. 36-5-1.1-12, the Marion County Election Board conducted a public hearing on August 22, 2002, in order to make a finding regarding the election of Town officers or the functioning of the Town’s government; and
WHEREAS, notice of the public hearing by the Marion County Election Board was published in two (2) newspapers of general circulation within Marion County at least ten (10) days prior to the hearing, as required by I.C. 5-3-1; and
WHEREAS, at this hearing, the Marion County Election Board did make a finding that the Town has not elected town officers or had a functioning town government during the ten (10) years preceding September 1, 1988, and the Town was not incorporated after August 31, 1988; and
WHEREAS, the Marion County Election Board certified its findings to me as the Chief Executive of Marion County by adopting a resolution, designated as Resolution Number 2002-03, a true and correct copy of which is attached hereto.
NOW THEREFORE, pursuant to I.C. 36-5-1.1-12(c), as the Mayor of the Consolidated City of Indianapolis and Chief Executive of Marion County, Indiana, it is hereby ordered that the Town of Brightwood be and is hereby dissolved. Any property owned by the Town of Brightwood shall be disposed of as required or permitted by law.
