CONSOLIDATED CITY OF INDIANAPOLIS COUNTY OF MARION STATE OF INDIANA
EXECUTIVE ORDER NO. 2, 2002
AUTHORIZATION FOR PROVISION OF LEGAL ASSISTANCE TO THE INDIANAPOLIS PUBLIC TRANSPORTATION CORPORATION
WHEREAS, the Indianapolis Public Transportation Corporation (IPTC) is a municipal corporation established under the laws of Indiana;
WHEREAS, the Consolidated City of Indianapolis (City) is a political subdivision established under the laws of Indiana;
WHEREAS, an audit of the IPTC completed by the City’s Internal Audit Agency on March 28, 2002, has revealed that persons and/or entities may have misused public funds;
WHEREAS, the federal government is conducting a review of the IPTC relating to, among other things, its use of federal funds;
WHEREAS, the IPTC is facing challenges to its budget that counsel for a serious attempt to recover any misused public funds by using cost-effective methods of recoupment;
WHEREAS, the Board of Directors of the IPTC has resolved that it would be of assistance to the IPTC that the City’s Office of Corporation Counsel provide legal assistance in the attempted recoupment of misused public funds; and
WHEREAS, it is in the interests of the public and of the efficient administration of government that the City make its Office of Corporation Counsel available to provide such legal assistance to the IPTC without charge of attorneys’ fees;
NOW, THEREFORE, by virtue of the authority vested in me as the Mayor of the City of Indianapolis and successor-at-law to the Board of Commissioners of Marion County, Indiana, it is hereby ordered as follows:
- The Office of Corporation Counsel is authorized to provide, without charge of attorneys’ fees, legal assistance to the IPTC in attempting to recoup public funds allegedly misused, including but not limited to the instituting of all appropriate legal proceedings.
- The Office of Corporation Counsel is authorized to establish such an attorney-client relationship with the IPTC as is customary and appropriate to carry out such legal assistance, and may report to the Board of Directors of the IPTC or its designees.
- The Corporation Counsel is authorized to assign such attorneys, legal assistants or other staff members as he deems appropriate and efficient in carrying out such legal assistance.
- The Office of Corporation Counsel shall spend no more than a total of three hundred staff hours during normal hours of employment performing the functions described by this order absent further authorization.
- This Executive Order shall become effective immediately.
