EXECUTIVE ORDER NO. 1, 2002

BI-ANNUAL UPDATE OF
COMPREHENSIVE EMERGENCY MANAGEMENT PLAN

WHEREAS, the terrorist attacks of September 11, 2001 in New York, the Washington, D.C. area and Pennsylvania raised concerns about emergency preparedness in cities across the nation; and

WHEREAS, since September 11, 2001, the Consolidated City of Indianapolis (the “City”) has conducted a complete and thorough review of its emergency preparedness; and

WHEREAS, an important aspect of the City’s emergency preparedness is the Comprehensive Emergency Management Plan for the City (the “CEMP”); and

WHEREAS, the CEMP describes the City’s response to an emergency or disaster, including the prevention and minimization of loss of life, injury and property damage, the provision of emergency relief, and the organization of manpower and chains of command; and

WHEREAS, the CEMP is prepared pursuant to the Civil Defense and Disaster Law of 1975, Indiana Code Section 10-4-1, et seq. (the “Civil Defense and Disaster Law”), and filed with the Office of the Clerk of Marion County (“Clerk’s Office”); and

WHEREAS, as part of the emergency preparedness review, the City consulted with public and private agencies and entities that have responsibility for taking certain actions in the event the CEMP is activated during an emergency or disaster, including federal, state and local governmental agencies, business, labor, industry, civic and volunteer organizations and community leaders; and

WHEREAS, on this date, the City filed a revised and updated CEMP with the Clerk’s Office; and

WHEREAS, the CEMP should be consistent with the most current emergency preparedness and response procedures, in accordance with Section 10(j) of the Civil Defense and Disaster Law; and

WHEREAS, the CEMP should be regularly reviewed, updated and republished in the future;

NOW, THEREFORE, by virtue of the authority vested in me as Mayor of the City of Indianapolis, Indiana, and as successor-in-interest to the Board of Commissioners of Marion County, Indiana, it is hereby ordered as follows:

  1. The Administrator of the Emergency Management Division of the Department of Public Safety shall be responsible for conducting an evaluation, review and update of the CEMP prior to January 1 and July 1 of each year.
  2. Following each bi-annual update, the Administrator shall file the updated CEMP with the Clerk’s Office. In the event an update is not required, the Administrator shall so notify the Mayor in writing, and a filing shall not be required.
  3. This Executive Order shall not limit the Administrator from reviewing the CEMP and filing an updated CEMP with the Clerk’s Office in the normal course of the business of the Emergency Management Division and pursuant to Municipal Ordinance Section 251-403.
  4. This Executive Order shall become effective immediately.
