STATE OF INDIANA

EXECUTIVE ORDER NO. 3, 2001

ESTABLISHMENT OF THE INDIANAPOLIS
CHARTER SCHOOL BOARD 
 

WHEREAS, Indiana Code Article 20-5.5 authorizes the Mayor of the Consolidated City of Indianapolis and Marion County, Indiana, to grant charters to organizers to operate charter schools located within the Consolidated City; and

WHEREAS, the same Indiana Code Article prescribes certain powers and responsibilities of the Mayor in connection with the granting of charters for the operation of charter schools; and

WHEREAS, the Mayor wishes to solicit the ongoing assistance of individuals whose knowledge and experience in the field of elementary and secondary education and business acumen uniquely qualify them to evaluate applications to establish charter schools, and to oversee the operation of charter schools;

NOW, THEREFORE, by virtue of the authority vested in me as Mayor of the City of Indianapolis, Indiana, and as successor-in-interest to the Board of Commissioners of Marion County, Indiana, it is hereby ordered as follows:

  1. The Indianapolis Charter School Board (hereinafter "Board") is hereby established.
  2. The Board shall consist of eight (8) members, each of whom shall be appointed by the Mayor for a term of one (1) year. The members will serve at the pleasure of the Mayor and will be eligible for reappointment. The members of the Board shall serve without compensation.
  3. It shall be the mission of the Board to advise the Mayor with respect to organizers' applications to establish charter schools located within the Consolidated City, and to assist the Mayor in holding accountable such charter schools and organizers who operate under a charter granted by the Mayor.
  4. In order to achieve its mission, the Board shall have the powers and duties, as follows:
    1. To review and adopt the Mayor's charter school application form;
    2. To adopt rules and guidelines specifying any technical requirements, in addition to those listed in IC 20-5.5-3-3, for charter school applications that, if not met, render a application technically invalid;
    3. To recommend to the Mayor the establishment of reasonable charter school application fees and oversight fees;
    4. To identify individuals to serve on the initial review teams;
    5. To review a charter school application received by the Mayor, and provide the Mayor with recommendations to accept or reject the application;
    6. To be responsible for the continuing oversight and ongoing review of the financial, educational, staffing, and facility status of charter schools and organizers who operate under a charter granted by the Mayor;
    7. To provide to the Mayor on an annual basis, or more frequently if the Mayor directs, a written report on each charter school operating under a charter granted by the Mayor;
    8. To adopt rules for the conduct and procedures of the Board's meetings which are not in conflict or inconsistent with the Indiana Open Door Law or Public Records Act;
    9. To establish guidelines for its members regarding ethical issues, including conflict of interest, particularly with respect to review and recommendations of charter school applications;
    10. To obtain the services of experts whom the Board finds necessary to accomplish its responsibilities; and,
    11. To perform such other duties with respect to charter schools in the Consolidated City as the Mayor may from time to time direct.
  5. The Board will have a chair, vice-chair and secretary, and may select such other officers it deems appropriate or necessary. In the absence of a Board rule to the contrary, the proceedings of the Board will be governed by the provisions of the latest edition of "Robert's Rules of Order Newly Revised."
  6. This Executive Order shall be come effective immediately.
