Added Protection Under the Law
Brizzi testified before the General Assembly in favor of a bill which makes it an A misdemeanor for someone convicted of domestic battery to knowingly or intentionally possess a firearm. That bill became law July 1, 2003.
I. C. 35-47-4-6. Possession of a firearm by domestic batterer.
(a) a person who has been convicted of domestic battery under I. C. 35-42-2-1.3 and who knowingly or intentionally possesses a firearm commits unlawful possession of a firearm by a domestic batterer, a Class A misdemeanor.
(b) It is a defense to prosecution under this section that a person's right to possess a firearm has been restored under I. C. 3-7-13-5 or I. C. 33-28-4-8.
