Charges Filed in Death of Four-Year-Old

Indianapolis – Marion County Prosecutor Carl Brizzi filed charges today against Christopher Montgomery and Courtney Simpson for the death of Simpson’s four-year-old boy, Elijah, late last week.

Montgomery has been charged with murder, two counts of A felony neglect of a dependent, of C felony neglect of a dependent, C felony criminal confinement, B felony possession of a firearm by a serious violent felon, D felony dealing in marijuana and D felony possession of marijuana.

Simpson has been charged with two counts of A felony neglect of a dependent, D felony dealing in marijuana and D felony possession of marijuana.

According to the probable cause affidavit filed by police, Montgomery allegedly threw Elijah after the boy did not respond to Montgomery’s request quick enough. Simpson then allegedly failed to seek medical attention for the child even though it was apparent he was severely injured.
