SHERIFF'S REAL ESTATE SALE RULES -- MORTGAGE FORECLOSURES
1. Notices, deeds, clerk returns and bid forms must be on 8 ½ by 11" paper. AS OF JULY 1ST 2008 ALL DEEDS MUST HAVE A DISCLOSURE FORM. One completed deed and two clerk returns must be received by the Civil Sheriff's Office within two days after the date of Sheriff's sale. PLAINTIFF BIDS ARE DUE 24 HOURS PRIOR TO SALE!!
2. Any added costs must be presented in writing prior to placing of bids. Without record of added costs,
property will be sold as specified in judgment.
3. All assignments must be presented in writing and file stamped by the Marion County Clerk prior to
bidding or properties will be sold and funds dispersed as specified in judgment. It is the responsibility
of the assignee to provide copies each time a property is presented for sale.
4. Prior to placing any bids, all persons bidding must have on deposit with the Sheriff's personnel
conducting the sale, a certified check or cashiers check equal to or in excess of the amount of any
bids submitted. NO CASH CAN BE ACCEPTED! Bids will be accepted from lien holders/plaintiffs enforcing judgment, limited to the amount of such judgment and added costs, as in #2, in lieu of cash deposits. If you have excess funds on deposit with the Sheriff's personnel, you cannot transfer or allow other bidders to use these funds to bid on any property in the sale
5. All sales are subject to any first and prior liens, taxes and assessments legally levied and assessed
thereon, or any other liens not properly set out in the lawsuit.
6. The Sheriff does not warrant, either expressively or implied, any title, location or legal
description on any real estate sold at the sale. Any prospective bidder should obtain their own
title evidence before making any bid on any properties in the sale.
7. Written bids on Sheriff's sale properties may only be submitted between the hours of 10:00 A.M.
and 3:00 P.M. on the day of the sale. No bids will be accepted before the sale. NO BIDS WILL BE ACCEPTED AFTER 3:00 P.M. Any properties upon which contested written bids are received or upon which no bids have been received by 3:00 P.M., will
go to oral auction at the hour of 3:30 P.M. and at such time, any person present complying with rule 4
may bid at the oral auction. All written bids must be submitted prior to 3:00 P.M., the clock to be used
for keeping time is at the discretion of the Sheriff's personnel.
Plaintiffs must have their bids submitted 24 hours PRIOR to sale.
8. All funds on deposit at close of sale will be returned or refunded the MONDAY immediately following
date of sale. Exceptions: If a bidder is not successful on any property, he may come up to Room
1122 after the sale to pick up funds on deposit.
9. All bids are final. No bid may be withdrawn or amended after being duly received and recorded
by Sheriff's personnel conducting the sale, except by court order.
10. No properties may be removed after 10:00 A.M. of the date of sale, without a court order.
11. The $200.00 USER FEE will be assessed on all sales for which the Sheriff's Department has received a notice for publication. This is in addition to any other fees legally assessed. All sales costs must be paid on or before the sale date.
All participants must observe the above rules.
