Service of Process

It is the responsibility of the Marion County Sheriff's Office, Judicial Enforcement Division, to process and serve legal papers and official Court Orders issued by the Marion Circuit Court, Marion Superior Courts, or by any other Local, State, and Federal agency.

All Service of Process, including Criminal and Civil cases, to be served in Marion County from other counties, must be mailed to:

PLEASE BE ADVISED:

If we receive papers that do not have the correct number of copies or case number on the papers, we will return to the law office from whence they came, at the expense of the law office.  If we do not receive the proper service fees with the case number(s) on the check, we will return to the law office from whence they came, at the expense of the law office.  If we receive papers with an address to serve that is outside of Marion County, we will return to the law office from whence they came, at the expense of the law office.

Please make checks payable to Marion County Sheriff.  Full case number must be included on all checks. 

 

*Indiana Code 33-37-5-15(A) Service of Process Fee

Sec. 15. (a) The sheriff shall collect a service of process fee of twenty-five dollars ($25) from a party requesting service of a writ, an order, a process, a notice, a tax warrant, or any other paper completed by the sheriff. A service of process fee collected under this subsection may be collected only one (1) time per case for the duration of the case. However, a sheriff may collect an additional service of process fee of twenty-five dollars ($25) per case for any post-judgment service. 

(b) The sheriff shall collect from the person who filed the civil action a service of process fee of sixty dollars ($60), in addition to any other fee for service of process, if: 

(1) a person files a civil action outside Indiana; and

(2) a sheriff in Indiana is requested to perform a service of process associated with the civil action in Indiana.
