Paternity Actions
Paternity Actions:
Paternity actions filed through the Juvenile Division of the Marion Superior Court are initiated by attorneys retained by the Petitioner. Other paternity cases are initiated by attorneys in the Marion County Prosecutor's Office and are filed in the Circuit Court of Marion County. To be accepted for processing, paternity actions must include:
- An Attorney's Appearance Form
- Original and four (4) copies of the Paternity Petition
- Original and four (4) copies of the Paternity Summons
- One (1) copy of the Order to Appear
- Child's name at birth, date and place of birth, race, sex, and name to be known after the paternity judgment is issued by the court.
- Father's name, date and place of birth, race and social security number.
- Mother's name, date and place of birth, race, maiden name, and social security number.
- The filing fee for a paternity action is $178.
- Type of service requested (Certified Mail, Sheriff) should be clearly stated on the summons. Sheriff's service fee of $13.00 must be made payable to the Sheriff.
- A statement must be included indicating with whom the child resides at the filing of the Petition.
- A total of four (4) self-addressed stamped envelopes including two (2) for the attorney of record, one (1) for the respondent, and one (1) for the respondent's attorney (if known).
