Sales Disclosure Process

Marion County Assessor

Sales disclosure forms are required by law (Ind. Code 6-1.1-5.5). The data is used by local assessing officials and the state for a variety of purposes including sale studies, equalization, and annual market adjustments of assessed values in non-assessment years.

 

In addition, Marion County requires all sales disclosure forms to be filed electronically.  Indpls. Code § 135-224.  Although electronic filing is required, a completed and signed paper form must also be presented along with the documents to be recorded.

 

In 2007, the Indiana General Assembly made a change to the process of filing sales disclosure forms.  In the past, the sales disclosure form was filed with the county auditor.  Under Senate Enrolled Act 287-2007 (codified at Ind. Code 6-1.1-5.5), the sales disclosure form must first be reviewed by the county assessor before it is filed with the county auditor.  The new law goes into effect on July 1, 2007.

 

To process a Sales Disclosure Form through a title company or attorney:

 

Most title companies and attorneys have the ability to prepare the sales disclosure form and a file it electronically through www.salesdisclosure.com.  Anyone who makes payment arrangements with www.salesdisclosure.com may also file the form electronically.

 

Title companies, attorneys, and other persons with billing arrangements with www.salesdisclosure.com must still make certain the paper form is properly completed and signed, and must present the paper form to the county assessor’s office for review.

 

Steps

 

1.        Enter the sales disclosure form data at www.salesdisclosure.com.

2.        Print a paper copy of the form and have the appropriate parties sign it.

3.        Bring the completed paper form and the receipt from www.salesdisclosure.com to the Marion County Assessor’s Office (200 E Washington St Ste 1121, Indianapolis IN).

4.        If the form was properly completed and signed, the County Assessor will stamp the form and send you to the Marion County Auditor’s Office (200 E Washington St Ste 801, Indianapolis IN).

5.        The Marion County Auditor will process the form, process the documents to be recorded, and refer you to the Marion County Recorder’s Office (200 E Washington St Ste 721, Indianapolis IN) to record the documents.

6.        If a form is rejected, you must submit a corrected form through www.salesdisclosure.com.  Salesdisclosure.com will be notified of the rejection to assist you with obtaining reimbursement of the fees associated with the incorrect submission.

 

To process a Sales Disclosure Form in the City County Building:

 

Some people do not have a payment relationship with www.salesdisclosure.com.   To comply with the requirement for electronic filing of the sales disclosure form, those persons should come to the Marion County Assessor’s Office for assistance.

 

Steps

 

1.        Blank forms can be printed from the State of Indiana website at http://www.in.gov/icpr/webfile/formsdiv/46021.pdf.  All sales disclosure forms must be completed and signed.

2.        Bring the completed sales disclosure form and documents to be recorded to the Marion County Assessor’s Office (200 E Washington St Ste 1121, Indianapolis IN).

7.        If the form was properly completed and signed, the county assessor will assist with the electronic data entry, stamp the form and send you to the Marion County Auditor’s Office (200 E Washington St Ste 801, Indianapolis IN).

3.        The Marion County Auditor will process the form, process the documents to be recorded, and refer you to the Marion County Recorder’s Office (200 E Washington St Ste 721, Indianapolis IN) to record the documents.
