Nut & Butt Puppys: Case Closed


INDIANAPOLIS – Yesterday, a Marion Superior Court ruled in the City’s favor in the case of The City of Indianapolis vs. Angela Cummings, owner of Nut & Butt Puppys. The Court found that Angela Cummings violated Sections 531-401, general requirements for care and treatment, and 836-2 of the Revised Code, for operating a pet store without a license.

The Court has ordered:

  • Angela Cummings must pay a fine in the amount of $6000 for the violations and $82 in court costs;
  • Angela Cummings cannot operate a pet store within the City of Indianapolis without first obtaining a license;
  • Angela Cummings cannot own or keep an animal in the City of Indianapolis; and
  • The Court further ordered that Indianapolis Animal Care & Control retain custody of the animals impounded from the store on December 19, 2002.

Below is the timeline of events for Nut & Butt Puppys:

  • November 6, 2002: Hoosier Branigin, Inc. began operating a pet store known as Nut & Butt Puppys at 7225 US 31 South in Indianapolis, Indiana. With less than one month in operation, Indianapolis Animal Care & Control received complaints from citizens concerning the unsanitary conditions of the store and the poor health of the pets being sold.
  • December 2nd: Indianapolis Animal Care & Control opened an investigation into the store’s practices and Angela Cummings was issued citations for 59 violations of care and treatment and one violation of operating a pet store without a license.
  • December 19th: 20 puppies seized from Nut & Butt Puppys.
  • December 20th: Nut & Butt Puppys receives temporary emergency suspension of license.
  • January 3, 2003: A hearing was held to determine further suspension or revocation of the store’s license.
  • January 10th: Nut & Butt Puppys operating license was revoked.
  • February 12th and 13th: A hearing was held to evaluate the care and treatment and pet store license violations.
  • February 19th: Angela Cummings found guilty on all charges.
