Public Defender

POSITION:  Office/Project Manager

POSITION SUMMARY: Position is responsible for providing administrative support to the Chief Operating Officer.  Position coordinates travel for witnesses and staff; conducts office banking, including claims, deposits, reconciliations and quietus revenue; coordinates reporting for agency grants; maintains and coordinates disbursement of portable office technology (i.e. cameras, laptops, etc); functions as Public Defender Board Secretary, including taking minutes, distributing and scheduling meetings a year in advance; determines the need of office supplies, equipment and materials and replaces or purchases office supplies and equipment as needed; responsible for contracts for attorney service and contract renewal each year; maintain the office internet and intranet websites and special projects, including but not limited to preparing reports as needed and responding to requests for public information.

QUALIFICATIONS:  High School diploma and/or GED and a minimum of five (5) to seven (7) years of work experience in a field related to the functions of this position with a minimum of three (3)  years prior related experience in a position with similar responsibilites.  Position requires a broad and comprehensive background of the Public Defender Agency operations, policies and practices.  Ability to coordinate multiple projects and meet various deadlines a must.  Ability to communicate effectively both orally and written.

POSITION:  Juvenile Division Chief

SALARY: $70,000.00 - $77,000.00

POSITION SUMMARY:  Included duties are the direction and review of staff's performance for quality and integrity, as well as ensuring the attainment of training objectives.  The Juvenile Division Chief is called upon to ensure adequate court coverage, effective representation from the division, and appropriate advice and counsel in complex legal and policy issues.  The Juvenile Division Chief maintains all data pertaining to the Public Defender Commission Standards and relevant information pertaining to the Agency's budget.  Participation with and in the courts is necessary, as well as maintaining relationships with other state and local agencies to form policies and procedures relevant to the best interests of our clients.  This person must be available to participate with the Chief Public Defender and all members of the Board of Managers in matters that impact the administration and policies of the juvenile division and the entire agency. 

QUALIFICATIONS:  Must have knowledge of criminal law and procedure, functions of relevant government agencies and some knowledge of the budgetary process.  Must be efficient at problem solving and possess the experience and ability to manage people and resources.  Must have basic computer skills.   Must have Doctor of Jurisprudence from an accredited college or university, a valid legal license to practice law in Indiana and five (5) years experience practicing law. Must possess advanced knowledge as it relates to juvenile law

POSITION:  Chief of Staff

SALARY: $ 81,616.00 - $94,860.00

POSITION SUMMARY:  Reports directly to the Chief Public Defender.  Position is second in command, overseeing activity in all Divisions, throughout the Agency.  Serves as the primary legal and policy advisor to the Chief Public Defender. Acts as Chief Public Defender or Serves as proxy in the absence of Chief Public Defender or as otherwise authorized. 
Duties include:  Developing policy and procedures regarding delivery of legal services, advising and assisting the Chief Public Defender, as well as Division Chiefs, Director of Operations/Human Resources, Training Director and Chief of Operations in matters that affect the administration and policies of the agency, advises on complex legal and ethical issues and performs tasks dealing with highly sensitive and critical management responsibilities, serves as Chief Public Defender's proxy at interagency meetings and working committees. Participates in required multi-agency undertakings, assists Chief Public Defender with inquiries and questions from media representatives and provides input to determine proper response, tracks, analyzes and reviews caseload activities of entire agency, and directs the allocation of resources to courts as necessary to properly staff courts and represent clients, assures compliance with Commission standards, maintains liaison function with Indiana Public Defender Council, Public Defender Commission and functionally corresponding attorneys at Marion County Prosecutor's Office, serves as Project Manager for the Case Management System.  Involved in employment outreach work to seek qualified employees at all levels in the agency, maintains knowledge base regarding ongoing issues in criminal defense, interacts with all office staff, indigent clients, judges, law enforcement officials, prosecuting attorneys, court personnel, media, state officials, private bar, bar associations, state commission members and Marion County Public Defender Board members.

QUALIFICATIONS:  Must have knowledge of criminal law and procedure, functions of relevant government agencies and the budgetary process.  Must be efficient at problem solving and possess the experience and ability to manage people and resources.  Must have basic computer skills.  Must have Doctor of Jurisprudence from an accredited college or university, a valid legal license to practice law in Indiana and ten (10) years experience practicing law. Must have extensive experience with complex litigation, indigent representation and criminal practice.  Must possess an interest in and passion for indigent criminal defense.

POSITION:  Juvenile Delinquency Attorney

SALARY: $43,000.00

JOB NUMBER: 2008-061

POSITION SUMMARY:  Primary function is to advocate the rights of the child client in delinquency cases ranging from A felony to B misdemeanor, and status cases (truancy, runaway, alcohol-related offenses and incorrigibility).  The Staff Attorney may represent parents on cases involving failure to insure the education of their children, and violations of the Parental Participation Order.  The Staff Attorney also represents children on matters in which the Marion County Prosecutor is seeking waiver to the adult court system.  The Staff Attorney must have a working knowledge of juvenile and family law, services available in the community, be involved in public service activities, and be instrumental in the client's habilitation or rehabilitation, where appropriate.  The Staff Attorney communicates not only with the child client but also with parents, guardians, custodians and Guardians ad Litem.  The Staff Attorney must be organized, write clearly and concisely, be able to communicate effectively with children and adults, and be able research, interpret and apply the law, and articulate the client's position to the Court and others, and advocate vigorously in trail.  This is a trail-litigation position.

QUALIFICATIONS:  Admitted to the Indiana Bar and member in good standing.  Major Felony qualified according to Indiana Commission standards.  Bilingual skills, particularly in Spanish are preferred but not necessary.  At least 2 years of criminal litigation experience including at least two (2) jury trails to completion.  This position is posted continually and does not guarantee an actual vacancy.

The attorney should have a minimum of two (2) years criminal litigation experience and must have tried at least two (2) felony jury trials to completion. Proficiency in computer use and word processing is desirable. The attorney should have good trial skills, as well as a professional courtroom demeanor. POSITION: Juvenile CHINS/TPR Attorney

SALARY: $43,000.00 + commensurate with experience.

POSITION SUMMARY: A Juvenile Division "Child In Need Of Services-Termination of the Parent-Child Relationship" Staff Attorney is well educated in juvenile and family law and is already, or is willing to be, trained as a litigator.  The CHINS-TPR Staff Attorney's primary function is to advocate the most difficult and serious of cases those involving a parent's right to raise his/her child.  The petition allegations arise from physical or sexual abuse, neglect, abandonment, need for medical or educational services, mental health services and/or poverty.  The child or adult client often presents with multiple issues:  mental health, drug, and poverty, physical, educational deficiencies or mental disabilities that have a profound impact on the majority of cases. Many are incarcerated or homeless, and the CHINS-TPR Attorney must be willing and able to address these issues with understanding, compassion, intelligence and insight. The CHINS-TPR Attorney works in the Marion Superior Court, Juvenile Division and other superior courts defending parents against petitions filed by the Division of Child Services-Marion County Office (formerly known as the Office of Family and Children or the Welfare Department), so the Attorney must possess experience in the juvenile justice system.  The CHINS-TPR Attorney must have a working knowledge of the services available in the community and be instrumental in the formulation of a client's plan for the reunification of his/her family.  The Court's requirement to order what is in the best interests of the child often circumvents or frustrates the legal rights of the parent, and the Attorney must be ready and able to vigorously defend the client.  The CHINS-TPR Attorney also works with the Child Advocate assigned to represent the interests and concerns of the children in the case.  The CHINS-TPR Attorney will be keenly aware that 'time is of the essence' in these cases due to the requirements of the federal Adoption and Safe Families Act, and current Indiana law. The Attorney must be a team player and work diligently until case objectives are met. The CHINS-TPR Attorney must be organized, manage time well, multi-task, write clearly and concisely, be able to communicate effectively with children and adults, be able to research, interpret and apply the law, and articulate the client's position to the Court and others.  Proper evaluation and investigation of cases is critical.   The Attorney must also be skilled at direct and cross-examination of lay and expert witnesses; be skilled in trial procedures, rules of evidence and appellate practice. The successful candidate will also have a working knowledge of child, adolescent adult and abnormal psychology; drug culture use and abuse; the DSM-IV and mental health; diversity and cultural issues; conflicts of law, international law and treaties; sexual abuse and areas of forensic medicine. The successful Attorney candidate will be required to follow specific administrative  and procedural protocol timelines and must be able to work successfully in a chaotic environment.

QUALIFICATIONS: Licensed to practice law in the State of Indiana and is a member in good standing. One (1) year of criminal litigation experience, two years of relevant practical experience, and must have experience and knowledge of juvenile and family law.

POSITION:  D Felony Attorney

SALARY: $45,134.00

POSITION SUMMARY:  The duties of an attorney are to vigorously pursue equal justice within the tenets of professional responsibility, to provide high quality, effective representation of counsel, and to implement agency policy whenever such implementation does not conflict with the interest of an individual client.  D felony attorneys represent clients charged with violating D felony offenses.  Typical D felony cases are theft, prostitution, operating a vehicle while intoxicated, and habitual traffic violators.  The sentence range for these offenses is six months to 3 years.  All cases are disposed of through jury trial, bench trial, guilty plea or dismissal.  This individual will report to the D Felony Division Leader . 

QUALIFICATIONS: License to practice law in the state of Indiana and is in good standing with the Indiana BAR.  Criminal litigation experience and general knowledge of the D felony courts and strong communication skills are preferred. POSITION SUMMARY:  Paralegals provide professional legal support to staff attorneys. Paralegals assist the public defenders assigned to his/her court as directed. Duties will include, but are not limited to: assist public defenders with case development, client interviews, witness interviews both in office and at the Marion County Jail, limited investigation, taking statements, photographs, measurements, subpoena preparation, record retrieval, document evaluation, witness organization during trial, legal research and document preparation, and any other duties connected with trial preparation and assistance as assigned by the Public Defender. Paralegals provide in and out of courtroom support for staff attorneys.  In addition this position may be required to appear in court on a daily basis, but at a minimum will participate in client's trials and any hearings designated by the attorney on a case. The position of the paralegal may include other administrative and court functions as directed by the Division Supervisor.

QUALIFICATIONS:  A High School diploma or equivalent is required. A college degree, Associate's Degree or certificate in paralegal studies or at least (1) year experience as a paralegal is preferred. Placement or assignment to a division will be based on qualifications and experience. Familiarity with research techniques or law enforcement is also a plus.  The candidate should be well-organized and work well under pressure. This position requires excellent oral and writing skills.  Must possess typing and computer skills.  A valid driver's license and dependable transportation is required for some paralegal positions. POSITION:  Misdemeanor Attorney

SALARY: $43,000

POSITION SUMMARY:  The duties of an attorney are to vigorously pursue equal justice within the tenets of professional responsibility, to provide high quality, effective representation of counsel, and to implement agency policy whenever such implementation does not conflict with the interest of an individual client.  Misdemeanor attorneys represent clients charged in misdemeanor of domestic violence courts.  Typical misdemeanor court cases include operating a vehicle while intoxicated, prostitution, and possession of marijuana, trespass, battery and public intoxication.  All cases are disposed of through jury trial, bench trial, guilty plea or dismissal.  This individual will report to the Misdemeanor Division Leader.

QUALIFICATIONS:  License to practice law in the state of Indiana and is in good standing with the Indiana BAR.  Criminal litigation experience and general knowledge of the misdemeanor courts and strong communication skills are preferred.
