Types of Discriminatory Employment Practices

 

Gender Identity - an individual having or being perceived as having a gender-related self-indentity, self image, appeatance, expression or behavior different from those characteristics traditionally with the individual's assigned sex at birth.

Sexual Orientation - an individual's actual or perceived identity or practise as a lesbian woman, gay male, bisexual person or heterosexual person.

Race Discrimination – It is unlawful to discriminate against any employee or applicant for employment because of his/her race or color in regard to hiring, termination, promotion, compensation, job training, or any other term, condition, or privilege of employment.

Sex Discrimination - It is unlawful to discriminate against any employee or applicant for employment because of his/her sex in regard to hiring, termination, promotion, compensation, job training, or any other term, condition, or privilege of employment. The law also prohibits employment decisions based on stereotypes and assumptions about abilities, traits, or the performance of individuals on the basis of sex.

Sexual Harassment – Any unwelcome attention of a sexual nature that occurs in the process of employment or seeking employment and jeopardizes a person's ability to earn a living.  Harassment ranges from annoyances and distractions to deliberate intimidation, threats and demands to physical acts.

Religious Discrimination- Employers may not treat employees or applicants less - or more - favorably because of their religious beliefs or practices. For example, an employer may not refuse to hire individuals of a certain religion, may not impose stricter promotion requirements for persons of a certain religion, and may not impose more or different work requirements on an employee because of that employee's religious beliefs or practices.

National Origin Discrimination – Employers may not treat someone less favorably because he or she comes from a particular place, because of his or her ethnicity, accent, or because of marriage or other association with someone of a particular nationality.

Disability Discrimination – Policies and practices that allow men and women employed in the same establishment to receive unequal pay for jobs which involve substantially equal skill, effort and responsibility and are performed under similar working conditions.

Retaliation – An act of "paying back" or "getting revenge" for an action one has taken. It is unlawful to retaliate against an individual who opposes unlawful employment practices or attempts to exercise their rights under the law.  Protection against retaliation for filing complaints, serving as a witness or assisting the Division of Equal Opportunity in any way during and investigation is provided and enforced by the Division of Equal Opportunity.
