Filing a Charge of Discrimination

If you believe you have been discriminated against by an employer, when applying for a job or while on the job because of:

  • race 
  • color 
  • sex 
  • religion 
  • national origin 
  • disability
  • sexual orientation
  • gender indentity

You may file a charge of discrimination with the Division of Equal Opportunity (DEO). Also, if you believe that you have been discriminated against in:

  • housing 
  • public accommodations 
  • education 
  • employment

You may file a charge of discrimination with the Division of Equal Opportunity (DEO).
A charge must be filed within 90 days from the date of the alleged violation, in order to protect your rights to charging the offending party. 

If you are employed by the City of Indianapolis, State of Indiana, Federal Government, or employed outside of Marion County, you should seek relief at the Federal Sector of the Equal Employment Opportunity Commission (EEOC) at (317) 226-7212.

When filing a charge with DEO, individuals should be prepared to provide the following information:

  1. The name, address, and telephone number of the person filing the charge.
  2. The name, address, and telephone number of the respondent employer, that is alleged to have discriminated, and the number of employees, if known.
  3. A short description of the event(s) with supporting documentation (if any) which caused the person filing the charge to believe that his or her rights were violated.
  4. The date(s) the event(s) took place.
  5. The names, addresses, and telephone numbers of any witnesses.
  6. The name, address, and telephone number of a person who always knows where to contact the person wishing to file a charge.
