Discrimination Complaint Process

 

1.   Intake Interview – Meet with an Equal Opportunity Analyst to determine if:
a.  The grievance is based on an alleged discriminatory act that occurred within 180 days of filing;
b.  If the violation occurred within Marion County; and
c.  If the employer has more than 6 employees.

2.     Complaint Accepted – A formal complaint is written.  The complainant must sign and verify the complaint.  The complaint will include a statement of the allegation and the remedy that is being sought.  A copy is sent to the employer or the entity charge is filed against.

3.     Investigation – An Equal Opportunity Analyst will be assigned the complaint to conduct an investigation.  The investigation is objective and will provide both sides an equal opportunity to offer information to support their positions. 

4.     Findings – The Complaint Adjudication Committee of the Equal Opportunity Advisory Board makes a finding of “reasonable cause” or “no reasonable cause” to believe discrimination has occurred.  The Notice of Finding is sent to the claimant and the respondent. 

5.     Finding of Discrimination – If “reasonable cause” to believe discrimination has occurred is found, the Office of Equal Opportunity will take affirmative steps to eliminate any discriminatory practice.
